A Tampa-based man is suing the state of Florida over a deal that allowed him to buy his Viagra pills without a prescription.
The Tampa Bay Times reports that the man, who was arrested in September after a search of his home, was able to buy the pills over the counter, but said that they were too expensive for the state.
The Florida Department of Justice's lawsuit is based on an Internet search conducted by the Florida Attorney General's Office that has identified two of the pills.
The FDA says the pills are being sold at pharmacies in Florida, but they are not authorized for sale to the general public.
The lawsuit claims that the man was not permitted to sell the pills because the pills were not authorized for sale.
According to the suit, the man received a package of pills from the state on the third day of a month and that they were delivered to his residence by a customer who did not want to return them. The customer said the pills were being sold in Florida, but he did not know what they were for.
The Florida Attorney General's office said it has not received any reports of complaints about the pharmacies it is investigating and does not believe the man is involved in the sale of the pills.
The man is seeking to have his arrest set for a trial in the U. S. District Court in Palm Beach on Monday.
On Monday, the Florida Department of Public Safety said it was investigating the case and is taking legal action against the state to recover $1.9 million.
The man is being represented by attorney Ken Schuette. He also said his wife is suing to recover the $6.6 million in damages.
